A restraining order is a court order that tells a person to keep away from someone, for example from their home, work or other places they often go. Being a victim of violence abroad can be especially hard without family nearby or when you do not know the language or the support system.

Who it is for

People who have suffered harassment, threats, domestic violence or other crimes and want the law to keep the other person away.

How it works

  • A formal complaint is made against the person.
  • Enough proof is given to support the complaint.
  • The court looks at the proof and decides whether to order the person to stay away. The order can be made to protect the victim while the case goes on, or as a final order after the trial, depending on how serious the offence is.

When someone is found guilty of domestic violence, a restraining order is normally made as part of the sentence.
