  • Shared property (sociedad de gananciales): most things gained during the marriage belong to both partners.
  • Separate property (separación de bienes): each partner keeps what is theirs.

How it works

  • First talk: finding out which system applies to the marriage and explaining what it means.
  • List of property: making a detailed list of what is shared and what belongs to each person, and checking who paid for what.
  • Reaching agreement: helping both sides agree, and preparing a plan for dividing things that a court can approve.
  • Court: if there is no agreement, representing you in court.
  • Finishing: writing up the agreement, having it signed before a notary (an official who certifies documents), and arranging the transfer and registration of property.
