Enduring Power of Attorney: Guardianship in Spain

Guardianship means a court gives someone the legal right to look after another person's personal and money matters when that person cannot do so themselves. This service is for families with a relative who, because of old age, illness or disability, can no longer manage on their own. It can be a hard and emotional process, and language barriers and unfamiliar laws can make it harder.

Who can be a guardian

• An adult of sound mind.
• Someone willing and able to take on the duties.
• The court must see the guardianship as being in the best interest of the person being cared for.

How it works

• A medical check is needed first to show that guardianship is needed.
• A formal request is then made to the court.
• The court looks at the evidence and hears from the people involved.
• If satisfied, the court names a guardian.
