About Tourist Rental License & Registration in Croatia

A holiday rental licence in Croatia, also called a tourist rental licence or a short-term rental permit, is in Croatian a rješenje (decision) allowing the owner to offer private accommodation, iznajmljivanje u domaćinstvu, together with the kategorizacija (the official star category of the room, apartment or house). This page covers the tourist rental licence and registration in Croatia: the Airbnb rules for owners, the permit and the category, the registrations that follow and the rules for flats in residential buildings. Some older lists and lawyer pages call this service “Tourism License Application”. It is for foreign owners of apartments and holiday homes, especially on the coast and the islands.

How a permit usually comes about

  1. The owner, with an OIB, makes sure the property is registered and was built lawfully, with a use permit or a legalisation decision.
  2. The application goes to the county administration (županija; in Zagreb, the city), which inspects the unit and decides on the permit and the star category.
  3. After the decision the owner registers with the local tourist board (turistička zajednica), records every guest in the national eVisitor system, and pays the tourist tax (turistička pristojba) and the flat-rate income tax that most private hosts pay (paušalni porez).

Points to watch

The rules have changed more than once. Amendments to the law on hospitality made a new permit for a flat in a residential building depend on the written consent of a qualified majority of the co-owners, including the neighbours next to the flat, with a transition period for existing hosts; towns may also limit new short-term lets in their plans. Whether a non-resident or a non-EU owner can hold the permit personally, or needs a trade or a company, depends on the owner's status. Further changes, including EU-wide registration numbers for short-term rentals, are under way; a lawyer confirms what applies when the application is made.

What a lawyer does

A lawyer checks the property and the owner's status, prepares the application and the co-owners' consent, follows the inspection and the decision, and works with an accountant on the tax side. For a flat owned with others see co-ownership disputes; for long-term tenants instead of tourists see renting out your property; for the host's taxes see tax services for the self-employed.

Questions and answers

Is a permit needed to rent on Airbnb in Croatia?

Yes. Offering accommodation to tourists, through a platform or directly, requires the permit and the category; listings without one are a frequent target of inspections and fines.

Do the neighbours have to agree?

For a flat in a building with several flats, a new permit now needs the consent of the other co-owners in the required majority. The rule is about residential buildings with several owners.

Can a foreign owner get the permit?

Often yes, but the form depends on the owner's residence and nationality. A lawyer checks this before the application.

Who pays the tourist tax?

The guests owe it; the host collects and pays it, often as a fixed yearly amount per bed.

  • The lawyer phoned me within 24 hours of my first email and explained the next stages very clearly over the telephone. The emails that followed were consistent and very helpful. She handled every stage efficiently, which made applying for the tourist licence on my property in Spain very easy. I was impressed by her persistence in getting the Guardia Civil to issue the passwords I needed to upload information to them, as Spanish law requires. I am very satisfied with the outcome.

  • I had an informal introductory meeting with the lawyer, who answered all my questions and offered much more information and many suggestions I had never considered. I found him extremely friendly and professional, and his English is flawless, so understanding him was never a problem. Next year I will use him for my first Spanish tax return, and I will then be better placed to comment on the quality and price of the service. So far everything has been very good.

  • I was buying a charter boat in Croatia and wanted somebody on my side to deal with some complicated arrangements and check that everything was as I expected. Thank God I was put in touch with the lawyer. She was diligent, tenacious and always right, and since I did not speak the language and lived far away in Australia, she was everything I needed. She was also warm and fun, and a pleasure to talk to. I look forward to catching up over coffee one day, which I have never imagined with any other lawyer I have worked with.
