About co-ownership termination in Turkey

This service is for people who own a property together with others, where no one owns a clear, separate part. This is sometimes called pro indiviso ownership. It often happens when several heirs inherit one home, or when a couple split up. If the owners cannot agree on how to use, run or sell the property, it can be hard for anyone to enjoy it. Ending the shared ownership settles the dispute and makes clear who has what.

How it works

The first step is always to try to reach a friendly agreement. Once the owners understand how long and costly the other path is, they often agree.

If no agreement is possible, a court case is started. The claim describes the property, the owners and the dispute. The other owners are officially told and can give their side. The court looks at the evidence, such as how much each owner paid and how each has used the property. It then decides, and may order the property to be sold or divided into parts. Finally, the decision is carried out, so that each owner is treated fairly.

What the service includes

  • A first talk with a lawyer who handles property disputes, to look at your situation and options
  • Talks with the other owner to try to agree on a sale, which is usually in everyone's financial interest
  • If that fails, starting the court case and dealing with the other owners' replies
  • Presenting the evidence and arguments to the court
  • Carrying out the court's decision, whether by selling and sharing the money or by dividing the property

A note on public auctions

A public auction is a poor way to get a good price for a property. A very low bid, even from the other owner, may be enough to win it. For this reason a lawyer may attend the auction for the client to keep watch.

What clients say about our service

  • I am hugely grateful to the lawyer for the support he gave me through the recent sale of my house, which turned out to be complicated. More than once it seemed the deal could collapse because of obstacles from outside, yet his persistence and practical approach proved invaluable. Whatever the hour, even around midnight, he was working to keep things moving and answering my many questions with patience and expertise. His professionalism renewed my trust in the legal process, and he was by far the most efficient solicitor I could have had. He handled absolutely everything from the first step to the last, with great knowledge and helpfulness. Without his work I would still own a Spanish property I no longer wanted, which was causing me a great deal of stress and worry.

    Co-ownership Termination
  • This service put me in touch with the lawyer. My separation is a very messy one, and I needed a lawyer I could rely on. He has paid close attention to my case and steered me in the right direction. Unlike most of the lawyers I contacted earlier, he began work straight away and, importantly, has always kept communication open. The case is far from over, but I am fairly sure he will carry it through to the end.

    Co-ownership Termination
  • I spent almost a year working with the lawyer on buying out my former partner's share of the home we owned together. Right away I was impressed by how quickly she replied and how much she cared about my case. It was a very challenging matter, yet she grasped the legal intricacies and explained complicated points clearly and patiently. She kept a high level of professionalism, updated me at each stage and left me feeling supported and well advised. Her command of property law was evident, and the case ended successfully. What set her apart was her personal approach and real commitment to my best interests; I trusted her abilities and am grateful for her guidance from beginning to end. I highly recommend her to anyone needing legal assistance, as her expertise and professionalism make her stand out in her field.
